Residents of long-term care facilities have specific rights under both federal and state law.  Below is a brief outline of some of these rights:

  • Be allowed to self-administer medications unless it is dangerous for the resident to do so.   (42 C.F.R. §483.10(n))
  • Be allowed to manage one’s own financial affairs.  Facilities are not allowed to “require” residents to deposit their personal funds with the facility.  (42 C.F.R. §483.10(c)(1))
  • Communicate with other individuals both inside and outside of the facility. (42 C.F.R. §483.10)
  • Be free from verbal, physical, mental, and sexual abuse, corporal punishment, and involuntary seclusion.  (42 C.F.R. §483.13(b))
  • Not be required to perform services for the facility. (42 C.F.R. §483.10(h)(1))
  • Not be physically or chemically restrained -- either with psychotherapeutic or antipsychotic drugs for the purpose of disciplining or for staff convenience, except in emergency situations where immediate injury to the resident or others is prevalent.  (42 C.F.R. §483.13(a))
  • To be treated with dignity, respect, consideration, and full recognition of individuality.  (42 C.F.R. §483.15(a)).
  • To have privacy during treatment and personal care.  (42 C.F.R. §483.10(e)(1))
  • To be allowed to receive and make phone calls in private.  (42 C.F.R. §483.10(k))

Arizona Office of the State Long Term Care Ombudsman
The primary responsibility of the Arizona Ombudsman is to investigate and attempt to resolve complaints made by or on behalf of residents in long-term care facilities. 

The Area Agency on Aging, Region I (AAA)
The AAA is a public/nonprofit private agency designated by the State of Arizona to ensure that the Federal Older Americans Act is followed.  The AAA serves as an advocate for older adults and provides information, assistance, and other services. 

Adult Protective Services (APS)
The APS conducts investigations into reports of abuse, neglect, or exploitation of seniors and vulnerable adults.  Additionally, APS provides such services as emergency shelter and counseling for victims of abuse. 

Arizona State Board of Examiners - Nursing Home Administrators and ALF Managers
The Board investigates all complaints and enforces the practice standards of the Administrators and Managers. 

The Peoria Police Department
The Peoria police department office offers protective services to Peoria seniors and other residents of Peoria.  It conducts investigations into severe cases of nursing home abuse (i.e., sexual assault, severe lacerations, burns, etc.).

The Administration on Aging

The Arizona State Health Insurance Assistance Program (SHIP)
SHIP is a free health-benefits counseling service for Medicare beneficiaries and their families or caregivers. 

The Doves Program

Governor’s Advisory Council on Aging
The Council develops and monitors programs and policies that affect Arizona seniors. 

Centers for Medicare and Medicaid Services (CMMC)
The CMMC is a federal agency that administers Medicare and Medicaid.  The CMMC regulates Peoria nursing homes and other health care providers with regard to Medicare and Medicaid services and benefits.
