Often times, wrongful deaths in nursing homes occur when there is overcrowding, inadequate staffing or staff that is not sufficiently trained.
Rather than admit there may be a problem, nursing home staff may attempt to cover up abuse or neglect in wrongful death situations. The family might be told that the patient “died in his sleep.” Or, they may suggest that an autopsy is not necessary. Clothing may not be available under the pretense that it was soiled, when the clothing may indicate bloodstains or other questionable evidence. These scenarios could indicate an “unexplained injury" or wrongful death.
If these situations occur, answers need to be given and family members should insist that any questionable death be explained and reported. An answer of, "we don't know" is unacceptable. Nursing homes have a legal duty to provide 24 hour a day protective care. When there is a fatal injury, do not settle for “whitewashing” of the incident by administrators or nursing personnel.
